5 Week Coaching Experience Terms And Conditions

Please read these Terms and Conditions of Use (“TOU”) carefully. You must agree to these TOU before you are permitted to use any of Cheerfulpreneur Co.'s digital or downloadable resources, membership, online course, one-on-one or group coaching, workshops, or trainings, or enter any online private forums operated by Cheerfulpreneur Co.(for any purpose), whether on a website hosted by Cheerfulpreneur Co. or a third-party website such as an online course platform.

If you do not agree with these TOU, you may not use the Coaching Experience.

As used in these TOU, the term “Coaching Experience” is defined to include the following: (i) Roslyn Thompson of Bright Yellow Door Pty Ltd as Trustee for Bright Yellow Door Trust trading as Cheerfulpreneur Co. (ABN: 179 361 751 19), its subsidiaries, affiliated companies, owners, members, managers, directors, officers, past and present employees, agents, coaches, representatives, successors and assigns (collectively “Company”); (ii) any online courses and coaching experiences created.

Your Coaching Experience includes the following during the 5 week Coaching Experience and starts the moment you complete your purchase:

- Step-By-Step Pre-Recorded Video Lesson: Every week, for 5 consecutive weeks, you’ll receive 5-6 practical and uplifting pre-recorded video lessons.

- 24 Months Access to all 25+ coaching videos so you can revisit and deepen your transformation at your own pace, whenever you need a boost.

- Coaching Worksheets.

- Access To Online Coaching Platform.

- Private 1:1 Coaching: 1 x 60 minute session via zoom, during the 5 weeks (AEST Biz Hours Only).

- One personal direct message check-in from me each week for 5 consecutive weeks from the date of purchase, via a direct messaging app.

Kindly review the participation requirements and Coaching Experience terms provided below, and fill in confirmation at the end. If this isn't completed, your payment receipt will serve as confirmation that you agree to abide by these terms and conditions.

Here are the requirements for participation and terms of this Coaching Experience. 

1. COACHING EXPERIENCE PARTICIPATION

1.1. I recognise the significance of personal accountability in achieving the desired outcomes of this Coaching Experience and will take ownership of my actions, decisions, and achievements. I am dedicated to the process of growth and continuous self-improvement and will remain open to receiving feedback.

1.2. Unless otherwise arranged, I will take responsibility for booking any included 1-on-1 sessions via the online Scheduling booking system. Access to these sessions apply during the timeframe agreed upon.

1.3. I respect that what is being provided in this Coaching Experience is only one piece of the puzzle. If I need more than what is offered, I will reach out for support from other places as well.

1.4. Regarding the other members of the group: I agree I will not give outright advice, try to solicit business, or in any way negatively impact their experience and learning.

1.5. I understand that meaningful change takes time and persistence, and I am willing to embrace the challenges that may arise on this transformative journey. I commit to fully engaging in the coaching process to the best of my ability with dedication and openness. I will share my desired outcomes and challenges during sessions to make the most of the coaching sessions and increase my chances of success.

2. PLATFORM ACCESS

Part of your Coaching Experience includes access to an online coaching platform, containing pre-recorded coaching videos. Receiving access to the online coaching platform comes with responsibility. 

Please use the online coaching platform with the care and respect with which it has been created and passed on to you. By showing this commitment, you make and keep the following agreement:

2.1. I understand that I can use the online coaching platform or any intellectual property (IP) of the Coaching Experience for my own personal purposes only.

2.2. I understand that the information contained within the online coaching platform and all of the material of Cheerfulpreneur Co. is Intellectual Property and is subject to copyright law. 

2.3. I will not share my login details, passwords, or any part of the online coaching platform with anyone who has not purchased the Coaching Experience.

2.4. I will not download, duplicate, share, or distribute the videos, worksheets, or any other materials, whether in part or in full, to individuals who have not purchased the Coaching Experience.

2.5. I understand that any violation of this agreement, including sharing materials or login details, may result in immediate termination of my access to the Coaching Experience without a refund.

3. TERMS

3.1. I assume all risk of injury, harm, damage or loss arising from participation in the Coaching Experience.

3.2. Session cancellations and/or rescheduling need to be made no less than 24 hours before any scheduled session via email – smile@cheerfuldaysco.au. No refunds apply for cancellations made with less than 24 hours, except in emergencies and agreed upon.

3.3. Sessions that are not scheduled within the agreed upon timeframe are forfeited and cannot be transferred to the following month. 

3.4. I will keep my commitment to the Coaching Experience as discussed and any arranged ongoing payments thereafter. I understand that no refunds are issued for payments made under any circumstances.

3.5. Information and guidance provided is general in nature and it is my responsibility to undertake due diligence before making any decisions.

3.6. I agree to participate and contribute according to the needs of the group to the best of my ability. Cheerfulpreneur Co. reserves the right to remove any participant from the Coaching Experience if they are negatively affecting the learning environment of others. 

3.7. As part of the Coaching Experience, my personal information that is relevant to my situation may be gathered. My information is completely confidential and my personal details will not be shared.

3.8. The turnaround time for replies, reviews, and feedback is 5-7 business days, though typically replies to questions are sent within 3-4 business days, unless Roslyn is on leave, or has provided prior notice. The expectation of reasonable use applies. 

4. PAYMENT

You agree to the Coaching Experience fees and payment schedule selected at checkout.

If paying by debit card or credit card, you give us permission to automatically charge your credit or debit card for all fees and charges due and payable to the Company, without any additional authorisation, for which you will receive an electronic receipt. You also agree that the Company is authorised to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers (e.g., credit card transaction processing, merchant settlement, and related services).

If payment is not received when due, the Company reserves the right to terminate your access to the Coaching Experience and all Content, as defined below, immediately and permanently.

If you fail to make any payment in a timely manner or voluntarily withdraw from the Coaching Experience at any time or for any reason, you will remain fully responsible for the full cost of the Coaching Experience.

You agree to reimburse the Company for all collection and/or legal fees and expenses necessitated by lateness or default in payment.

5. REFUNDS

Because of the extensive time, effort, preparation and care that goes into creating and providing the Coaching Experience, we have a no refund policy. Unless otherwise provided by law, you acknowledge that we will not offer refunds for any portion of your Coaching Experience payment and no refunds will be provided to you at any time. By using and/or purchasing our Coaching Experience, you understand and agree that all sales are final, and no refunds will be provided.

All licences regarding the Content (defined below) provided under these TOU will immediately terminate upon the Company’s granting of a refund if required by law. You shall immediately cease using the Content and shall destroy all copies of the information provided to you, including without limitation: video recordings, audio recordings, forms, template documents, worksheets, slide shows, membership areas, and other resources.

Company reserves the right, in its sole discretion, to determine how to address a participant who violates these TOU. Therefore, if a participant disagrees with how the Company addresses another participant and requests a refund, the Company will deny such request.

Furthermore, if a participant violates these TOU, the Company reserves the right, in its sole discretion, to offer the participant another opportunity to abide by these TOU. If a participant disagrees with the Company offering another participant a second opportunity to follow these TOU, no grounds for a participant to receive a refund would be created, and any request for a refund on this basis shall be denied.

If, in the Company’s sole right and discretion, you persist with behaviours or actions that violate these TOU, the Company may terminate your access and participation in the Coaching Experience without notice and without refund.

The Company may offer additional Coaching Experience elements for a subgroup of participants, as further discussed in this TOU. The Company reserves the right, in its sole discretion, to offer participation in these additional Coaching Experience elements to specific participants. If a participant is denied participation in these additional Coaching Experience elements, no grounds for a participant to receive a refund would be created and any request for a refund on this basis will be denied.

Since we have a clear and explicit Refund Policy in these TOU that you have agreed to prior to completing the purchase of the Coaching Experience, we do not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company or payment processor. If a chargeback is placed on a purchase or we receive a chargeback threat during or after your purchase, we reserve the right to report the incident to credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account, which could have a negative impact on your credit report score. The information reported will include your name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.

6. COACH-CLIENT RELATIONSHIP

The coaching relationship is co-creative, meaning that the coaches and you are equal partners in the coaching session.

a. Your Coaches’ Responsibilities

• Your coach is trained to use communication skills and coaching tools to support you as an equal partner throughout the coaching process.

• Your coach will provide guidance to group participants based on information provided.

• Your coach may answer questions through whatever forum your Coaching Experience provides, such as via the Company’s website, a social media forum, live event, private message or live group coaching call.

b. Your Responsibilities

• You agree to complete all tasks assigned during the Coaching Experience, including but not limited to watching or listening to videos, completing worksheets and assignments, and attending coaching sessions.

• You agree that your relationship with the Company is that of a coach-client relationship and that no other professional relationship has been established.

• You agree that the coaching is not to be used as a substitute for professional advice of any kind, including medical, mental or other qualified professional help and you agree to seek professional guidance for such matters, should they arise, independent of the coaching relationship.

7. YOUR CONDUCT

The Coaching Experience is a “pitch free zone.” You agree you will not pitch, promote, market, or sell any other products, groups, programs, or events to Coaching Experience participants on any Company website or third-party forums operated by the Company, whether or not officially sanctioned, owned, or operated by the Company. This means you agree not to form, or ask Coaching Experience participants to join groups on social media or any other platform, or in-person meetups, based on interests or locality. You agree you will not invite Coaching Experience participants to participate in events, such as a meetup or seminar, without first receiving approval from the Company. You agree not to market, promote, or sell products or services to Coaching Experience participants, unless you are authorised.
